This pamphlet answers the following questions about the civil rights of students with hidden disabilities and the responsibilities of ED recipients: (The addresses and telephone numbers of the OCR regional offices are included at the back of this pamphlet.) ED maintains an Office for Civil Rights (OCR), with ten regional offices and a headquarters office in Washington, D.C., to enforce Section 504 and other civil rights laws that pertain to recipients of ED funds. Recipients of this assistance include public school districts, institutions of higher education, and other state and local education agencies. Department of Education (ED) enforces Section 504 in programs and activities that receive financial assistance from ED. shall, solely by reason of her or his handicap, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.' Section 504 provides that: 'No otherwise qualified individual with handicaps in the United States. Section 504 protects the rights not only of individuals with visible disabilities but also those with disabilities that may not be apparent. Section 504 of the Rehabilitation Act of 1973 protects the rights of persons with handicaps in programs and activities that receive Federal financial assistance.

That would be far less effective than a 504 though, especially if admin is really pushing “no headphones” down their throats.If you are a student with a hidden disability or would like to know more about how students with hidden disabilities are protected against discrimination by Federal law, this pamphlet is for you. Some will be assholes, most will probably try to work with you. Individually, you could also talk to your teachers on the first day after class about it and see what you can work out. Your parents will have to be involved in the process to make it happen. I’ve also had students who were allowed to eat lunch in the office as a 504 accommodation.Ī 504 is the only real way to ensure that you get to use headphones while working independently. You may also be given other accommodations, such as a cool off pass or the ability to work in the office when needed. Ideally the language will be something along the lines of “Student may use noise-cancelling headphones as needed” or “student may use noise-cancelling headphones when overstimulated.” You will not be able to use them during instructional time but could consider discussing use during passing periods and lunch if those are noisy. You will then need to get the use of headphones put into your 504. There will be a meeting with your parents and admin/counselor (you can also attend and should if possible). The simple version is this: you’ll need your doctor to make note of your diagnosis, then your parents will need to request a 504 from the school. i would always shut down in that class because i couldn't properly help myself. which is the reason why i completely flunked algebra last year since my teacher didnt allow any electronics. Oh also my anxiety disorders dont just cause me to have panic attacks, they can cause me to shut down and just give up if not taken care of. if anyone has a 504 plan or anything like that can you please give me some tips?

i've heard of accommodations and 504 plans and i want to try and get an accommodation so that i can have my music but im not sure how to bring it up or who to bring it up with. that being said i have a ton of anxiety about the upcoming school year. i've tried a lot of things but music has been the only effective thing for me. last christmas i got noise canceling headphones and they've helped me so so so much in every situation im put in.

now i was diagnosed with social anxiety disorder and general anxiety disorder in 5th grade and since then the only thing that has helped me through school was listening to music through my headphones/earbuds. I'm going into my junior year of high school this year and i'm nervous as they are implementing a new rule that bans phones and headphone/earbuds and the only electronic we can have is our district assigned ipad.
